Client/participant acknowledges that training and/or programs purchased under this agreement include participation in strenuous physical activities that might cause injury including, but not limited to, heart attacks, muscle strains, pulls or tears, broken bones, skin splits, heat exhaustion, knee/lower back/foot/shoulder/hand injuries and other illnesses, soreness, or injury however caused, occurring during or after clients participation in these physical activities.  Client/participant acknowledges that such risks include, but are not limited to, injuries caused by the negligence of an instructor or other person, defective or improperly used equipment, over exertion of client, or unknown health problems of client.

Client/participant assumes all risk and responsibility involved with participation in these physical activities.  Client/participant affirms that client/participant is in good physical condition and does not suffer from any disability that would prevent or limit participation in the physical activities.  Client/participant acknowledges participation will be physically and mentally challenging, and client/participant agrees that it is the responsibility of client/participant to seek competent medical or other professional advice regarding any concerns or questions involved with the ability of the client/participant to take part in these activities.  Client/participant agrees to assume all risk and responsibility for exceeding client’s/participant’s physical limits.

Client/participant agrees to release Elite Fitness Training and Coaching Inc., and any and all of its owners, employees, and agents, including independent contractors, from any and all liability, claims and or litigation resulting from training programs and the physical activities, even if caused by the negligence, gross negligence, intentional acts or omissions, and or any other type of fault of Elite Fitness Training and Coaching Inc., its owners, employees, or agents including independent contractors.

By signing this agreement, client/participant has read, understood, and agreed with all terms and conditions of this agreement.
